It supports the promotion of economic growth and stability as well as develops the Kingdom's standard of living. After that, the Second National Economic and Social Development Plan (1967-1971) proposed to set up an orderly securit ies market in order to gather additional capital to support Thailand's industrialization and economic development. The modern Thai capital market can be divided into two phases, â€Å"The Bangkok Stock Exchange† which was privately owned and â€Å"The Securities Exchange of Thailand†.The BSE finally ceased operations in the early 1970s because of a lack of official government support and a limited investor understanding of the equity market Establishment of the Stock Exchange of Thailand Despite the failure of the BSE, the concept of an orderly security market had attracted a lot of Thai people attention. In 1969, as recommended by the World Bank, the government acquired the services of Professor Sidney M. Robbins from Columbia University to study the development channels of the Thai capital market.In 1972 the Government took a further step in this direction by improving the â€Å"Announcement of the Executive Council No. 58 on the Control of Commercial Undertakings A ffecting Public Safety and Welfare†. The changes were allowed Government to control more over the operations of finance and securities companies. After that, in 1974, â€Å"The Securities Exchange of Thailand† (SET) was enacted allowing the investment to save in the capital market. By 1975, the basic legislative framework was in place and the Securities Exchange of Thailand officially started trading.On January 1, 1991 its name was formally changed to â€Å"The Stock Exchange of Thailand† (SET). Primary Market The SEC looked over a company that wants to issue new securities, an initial public offering (IPO) or additional securities to the public. The company must first apply for SEC approval and comply with its filing requirements. Then, the SEC is requi red to review the financial status and operations of the company before allowing the firm to issue securities to the public. Secondary MarketSecurities may be traded in the secondary market once the issuer has applied for and been approval by the SET. Operations The Stock Exchange of Thailand is a juristic entity that was set up under the Securities Exchange of Thailand Act, B. E. 2517 (1974). Operations started on April 30, 1975. Its main operations include securities listing, supervision of listed companies and information disclosure, trading, market surveillance and member supervision, information dissemination and investor education. Moreover, its duty is to promote saving and long term financial planning for developing the economy.SET is a center for trading of listed securities without distributing any profit to members. Board of governors Regulatory Framework The SET Board of Governors is comprised of a maximum of eleven people, five of whom are appointed by the SEC, and five who are elected by SET members. The SET President, appointed by the Board, is an ex-officio member of the Board. The Board is also responsible for formulating the SET policies. Management The organizational chart of SET can be classified into two major parts which are Exchange Function and CMDF Function.Each function’s organizational structure can be seen below. | | SET's Role The Stock Exchange of Thailand has been continuously improved the management system of listed Thai companies to have good governance. SET was started to study about the roles  of audit committee in 1995 before the financial crisis. After that, it issued a listing requirement indicating that all listed companies have an audit committee in early 1998. In that year, the SET also issued a guideline namely â€Å"Code of Best Practices for Directors of Listed Companies† to be a guild role of audit committee.Two years later, the Good Corporate Governance Committee, consisting of representatives from a variety of professional organizations, disseminated a report on corporate governance which set a framework to be used by organizations in the Thai capital market for developing good corporate governance systems and practices. The Thai government designated the â€Å"Compass for Good Corporate Governance† and set up the National Corporate Governance Committee (NCGC). In the same year, SET also proposed fifteen principles of good corporate governance for listed companies to implement.The listed companies have to apply the fifteen principles and are required to demonstrate in their annual registration statement (Form 56-1) and annual reports starting from the accounting period ending December 31, 2002. In July 2002, the SET has established the Corporate Governance Center to help listed companies develop their corporate governance system. The Center provides consulting services to and exchanges ideas about corporate governance practices with directors and executives of listed c ompanies, as well as those of firms preparing to be listed companies.Corporate Governance Center Background The SET has established the Corporate Governance Center to support listed companies. It encourages the company to have good corporate governance and stakeholders include shareholders, suppliers, customers, creditors, employees, and the community etc. Corporate Governance Center builds to have confidence investment in Thai capital market which support the knowledge about corporate governance including the developing good corporate governance system and practices. . The Center of consulting service Giving advises and exchange idea about corporate governance practices with directors and executives of listed companies as well as those of firms preparing to be listed companies. 2. Corporate Governance Self Assessment Evaluation was followed by the rule of listing company 3. Producing and disseminating a variety of information and materials as guidelines. 4. Holding activities to he lp educate listed companies' directors and executives. Products and ServicesOne of the SET’s missions is to â€Å"Offer a wide range of attractive products and services to create value and match financial opportunities across different segments of business and investors. † SET has continuously developed new products and services and improved the system to satisfy needs of the investors. SET group supervises trading activities and market participants to ensure that the market is fair, orderly, and transparent. The products and services of SET are as following. Product The products that SET offers can be classified into 5 major categories; equities, bonds, derivatives, exchange-traded fund (ETF), and derivative warrants.The more details of each type are discussed as following. 1. Equities Equity trading is the trading of securities issued by public companies where shareholders have a direct stake in the company as well as the right to vote in shareholders’ meeting s. The secondary markets for equities trading are The Stock Exchange of Thailand (SET) and Market for Alternative Investment (MAI). Types of equities are ordinary shares, preferred share, warrants, unit trusts, non-voting depository receipt, and depository receipt (DR). SET and MAI are different in terms of the types of equities traded.On SET, investors can trade all types of equities, whereas on MAI preferred shares and depository receipt (DR) are not traded. Market for Alternative Investment or MAI was established in June 1999 in order to encourage the smaller firms with potential high growth and innovation. MAI serves as a new fund-raising source for such firms and new alternative investments for investors who are interested. The vision of MAI is â€Å"We strive to be the right and efficient exchange creating value for high potential, innovative and ventures companies in ASEAN. † The core values of MAI are to be focus, accountable, networking, zealous, and innovative. . Bo nds After a bond is issued and sold in the primary market, the bond can be electronically traded through Bond Electronic Exchange (BEX), where investors can buy and sell bonds. The market was first launched on November 26th, 2003, and its goal is â€Å"to develop all facets of the Thai bond market to reach an international standard, on par with other mature bond markets in the rest of the world†. 3. Derivatives Derivatives are traded through Thailand Futures Exchange or TFEX which was established on May 17th, 2004. TFEX play a big role in Thailand economy in stabilizing and sustaining financial market and corporates.Derivatives are used to protect companies from unanticipated change of underlying assets which might be the raw material of the company. In other words, TFEX allows investors to hedge their risk by utilizing derivative products. TFEX has continuously introduced new products to be traded on the market. Up to the present, TFEX has a total of 11 products in 5 categor ies, which are equity, interest rate, precious metal, energy, and currency. First category, equity derivatives have a total of 4 types, which are SET 50 Index Futures, SET 50 Index Options, Sector Index Futures, and Single Stock Future.Second, derivatives that are traded on interest rate are 3-Month BIBOR Futures, 6-Month THBFIX Futures, and 5-Year Government Bond Futures. Third, derivatives for precious metal are 10 Baht Gold Futures, 50 Baht Gold Futures, and Silver Futures. Forth, derivative on energy price is Brent Crude Oil Futures. Fifth, the currency derivative is USD Futures. 4. ETF Exchange-traded fund or ETF is an open-ended mutual fund which is traded on the stock exchange. Through brokers, ETF investors can buy and sell at any time during the trading hours at the prevailing price when the order is executed.The main difference between normal mutual funds and ETF is that mutual fund is normally traded via asset management company or a fund issuer at the end of the trading day while ETF has real-time NAV or Indicative NAV which is calculated throughout the trading hours. With the help of designated market maker or liquidity provider, it allows investors to trade at the market price at any time. ETF is a passive management fund since it basically invests in a basket of underlying stocks which can be SET 50 Index, a stock sector index, commodity index and commodity price such as gold price and oil price.Mostly, ETF is the replicate of a stock index, making the expense and management fee lower for ETF. In contrast, mutual fund is more active making the cost of management more expensive as well. 5. Derivative Warrants (DW) Derivative Warrants give the holder right to buy a stock or an underlying security at the pre-determined price within the stated period for certain quantity. The issuer of derivative warrant is a third party, not the issuer of the underlying securities. Warrants and Derivative Warrants are different in many aspects, as shown in the foll owing table Services 1. Information serviceDue to SET comprehensive, accurate and up-to-date source of Thai listed companies information, SET provides information service for customers who would like to access and disseminate trading or listed company information either with commercial or non-commercial purpose. Major customers of this service are member companies, data vendors, presses, academic institutes, mutual funds, governmental agencies and general investors. SET Information Service is classified into 3 categories; a. Datafeed (raw data for further application) b. SETSMART or SET Market Analysis and Reporting Tool c.IR website service for SET listed companies 2. Listing service on SET Companies that are interested in listing itself on SET have to meet many rules and regulations. Being a listed company gives the company many advantages. The company will have a larger source of long-term capital that is crucially important to enhance its operation, expansion and competitiveness . The company will obtain a better and positive public image due to its high standard and transparency giving the company with higher bargaining power and company’s credibility. When the Laptop is in Battery mode, connect the external USB device which are essential and remove them immediately after use, otherwise these devices will draw power from Laptop. 4. Always remove Charger/adapter from Main when the Laptop is not in use. 5. Delete unwanted files then and there otherwise it may occupy more space. 6. Whenever external storage device is required to be used, please scan before use. 7. Clean the Laptop monitor every day using soft cloth. And not by fingers. Clean the eye board using paint brush. 8. Always lift or hold the Laptop with both the hands. Handle carefully. 9. Keep the Laptop in the bag provided when pot use. 10.Keep the Laptop with proper ventilation 11. Place the Laptop in plain and smooth surface while using. 12. Insert the External devices gently in the proper port. 13. Open and close the Laptop gently, otherwise the hinges may break. 14. In case of any problem with the Laptop, register your complaint and approach the nearest service centre i ndicated by ELECT Don's 1. Do not place the Laptop closer or on to any electrical device such as Microwave Oven, TV etc and directly under sunlight. 2. Do not keep any liquid such as water, beverages near Laptop so as to avoid spill over on keyboard.. 3. Do not keep any book or heavy weight items on the Laptop. 4.Never keep the laptop in â€Å"ON† condition in the bed while sleeping. Always ensure that the Laptop is switched off and kept away from the bed before going to sleep. 5. Obama’s Foreign Policy on China

President Barack Obama and his administration’s foreign policy toward China can be summed up in one word: conciliatory. Conciliatory is not in the form of any weakness or appeasement, but rather the realization that in the 21st century global market, China is a main player on the world stage. Obama’s foreign policies are a departure from the previous administration. George Bush’s unilateral foreign policies were deemed domineering, even belligerent.From an international standpoint, Anti-American sentiments were at an all-time high during Iraqi War driven years. In America, the domestic stance after 9/11 saw this as an extension of patriotism and commitment. Nowadays, both domestically and internationally, many pundits would argue that Obama’s policy record in China inspires hope and optimism. President Obama is acknowledging the fact of a much more multipolar world exists where America cannot take all of the leadership roles by itself. Yet, at the same tim e, the world cannot go forward without America.In this respect, China needs a wide open market where they can export all their manufactured goods to consumers worldwide. Thus, it is a mutual benefit for China to have good international relations with other societies to acquire raw materials and sell products to overseas companies. President Obama’s policies toward China reflect a forward marching multilateral approach that deliberates an equal level playing field in terms of economic opportunities so that not one country can monopolize or control the global market.There is a thin line when it comes to economic diplomacy and military presence, so in regards to the currency value of the Chinese Yuan/Renminbi, the Obama administration has used strategic requests to the World Trade Organization and United Nations to sanction China on purposely keeping their currency low. These formal accusations were discussed early this year between President Obama and President Hu Jintao. There has been a consensus among the world leaders to use fair trading practices to help benefit all the countries especially in the delicate market of Asia Pacific.In this regards, even though the move is controversial, President Obama has ramped up military presence in the Pacific to police the trade waters and to secure areas where there were less American presence in previous years. These movements have alarmed China and Japan in particular but with the WTO and UN backing some of the agreements, Obama is hoping China welcomes some of the military help not as a threat to China’s national interests but a welcomed ally to settle any disputes in international waters with the recent troubles with Japan and other regional issues that arise.President Obama said that he was pleased to see the â€Å"peaceful rise of China† and hoped to continue to support China in its currency matters to ensure a more balanced way of doing commerce. (US Policy 2012) In May of this year, China le t the renminbi hit a low of 0. 9 exchange value versus the dollar. China contends the economy was slowing â€Å"sharply† thus had no choice but to try to boost its exports as a way of mending some of the bleeding (NYTimes May, 2012) This has caused much headache for the United States because its trade deficit with China has gone over $290 billion dollars last year.The Obama administration has pressed hard for three years to let the renminbi to appreciate at a faster rate than it has been. Europe also has had some struggles with this fact because for China lowering the currency allows for competitive trade in exports but brings up the cost for imports so there is less competition inside China so its citizens benefit while other countries do not. In any case, Obama is trying to build lasting bridges of mutual respect so that in the long run, the peaceful rise will end with a peaceful future.In a sense, I believe every country must make its own interests ahead of the world to se cure its citizens every benefit that is known to man. But, on the other side, without a world, it is hard for a country to reap the benefits of trade if everyone increases tariffs or lowers their currency. This is a double-edge sword that does not have an easy solution so I understand both sides and that no country is living in a vacuum. There are a quite a bit of complexities and consequences to consider and I believe there will be a mutual success in this issue.Concerning Human Capital, the Obama Administration has also pressed hard to improve the human rights issues in China in terms of economic policies to benefit workers and their family situations. Historically, having the highest population at a staggering figure of over $1. 3 billion people, the human labor supply is more than available at any given moment. Thus, United States especially has outsourced countless manufacturing companies and jobs to China. This reality the President clearly stated will not change anytime in th e future so this must be an accepted reality. (Ivaneishvili 2012) So, he Obama administration has sharply criticized China for their lack of enforcement and laws to deal with such violations. But, this criticism as the State Department states applies to the United States as well, but the United States has laws to deal with this issues so the criticism is being put in a way not to outfight offend Chinese policies but to encourage an increase in the priority of the Chinese government to follow up actions to remedy the situation (Berg 2012). The State Department also applauded China for the actions that China already has taken to ensure better working conditions and labor rates.This issue hurts at the heart of any country because human capital affects the very lives each person is trying to save. The truth of the matter in my opinion is that every country does have gross human rights issues. The problems in China are magnified and pressed by most countries because of the sheer number o f human labor that exists in China. Thus, as China continues to rise and become an economic superpower as it is becoming, those concerns will be dealt with because the people inside will and cannot stand for harsh living conditions.But, this is also the crux of the matter because if the people inside working in those factories do not care, how will the bosses ever face the truth and do something about it. Moreover, the Chinese government must also take steps to allow unions to form and protest to go on even though that might be against the government itself. As long as peaceful protests are taking place, a mutually healthy society with certain liberties will allow for better conditions all around. The sanctions or false accusations only lead to more difficult climate for genuine diplomacy to take place.The Obama Administration has done their best to limit some of the criticisms, instead, suggesting some ideas and working out plausible solutions to ensure the embassies on the ground in China can be an instrument to help both sides make the right judgments and calls on the spot for every situation that may arise (Berg 2012). Countries are going to continue to outsource jobs into China because of such cheap labor. In this sense, Americans can obtain ever increasingly cheaper products while China gains more jobs for its citizens.I do not see any reason for not forming better political allies in this respect. Lastly, there has been heated contention on the political issues vis-a-vis North Korea, Iran, and Taiwan that affect the globe economically. President Obama and his administration have recently sanctioned some banks in China that have allegedly used to fund certain radical Muslim groups and Iranian nuclear proliferation aims. The Chinese government certainly denies any wrongdoing on the part of the government and so that is not the issue (NYTimes 2012).There is no doubt China and India have become large consumers of oil and natural resources over the last few years have shifted the market that oil and coal producers desperately needed (Chang 2012). Iran and the Middles East supply most of the oil for China while America has supplied a lot of the coal for China. The rate of increase is at a huge figure of 8% a quarter growth. That is a huge supply. This type of consumption has been a blessing for many number of countries including the United States so the Obama Administration on these terms are delicate to file complaints on behalf of International Labor Unions, but he has to his credit.On the other hand, many countries including China appreciate American presence but not American intervention. To connect to two issues, some of China’s unilateral policies with these countries affect national security and oil prices in America. Thus, the two are irrevocably tied together. It is not only China but Russia as well. The State Department has taken certain measures to cut the finances of certain groups or countries that have ties to terro rist organizations and nuclear goals. North Korea has been one of the countries that China seems to be passive towards.President Obama has been careful to be too unilateral or assertive in these matters but with the recent change in power in North Korea and the upcoming elections in Iran, there is a vested interest in the Obama administration to secure a more peaceful region in Asia and the Middle East. The purpose of terror is to disable and terrorize Western populations as a whole so the pressure from Americans and other Western countries to secure the Middle East has set a fire to Obama’s more multilateral approach (Obama 2012).The research is not there for an easy explanation for these events and situations. I can see why China continues to have relationships with Russia and Iran. I can also speculate why the continued help to North Korea. Most of these countries do sit right on the border of China so that reason is obvious to keep your friends close and enemies closer, b ut that is just it. I do feel they are enemies of China rather mutual partners. I think this is what America and Obama worries about. I believe the best ways to go about this for both countries are for more transparent policies without fine print.Relationships cannot be built on lies and deception and in my fair and balanced view, there has been plenty of that from both sides, so it is important to be transparent and open in the discussions to help liberty and economic success to grow. In this way, a peaceful China and peaceful Middle East helps everyone prosper. In conclusion, President Obama and his administration have embarked on a different path from the previous administration because of the new world order that we all face in the world. Conciliatory as a method for foreign policy has been an effective means to not isolate one country over another.In other terms, using multilateral agreements and combined pressures have made progress in China. I believe one taste of liberty, an y person or group cannot wait for more so as China grows economically, it is the best interest of both countries to help one another in terms of currency, human rights, and political allies incidentally natural resources. The growth of China in recent years has been tremendous and there is so much room for it to grow more. Internally, Obama has repeated that the people in China as consumers need to consume more (US Policy 2012).This goes without saying and I believe that is happening in China. President Barack Obama is up for re-election and I am not sure who is going to win but there have been pretty strong words in regards to China and foreign policy so this paper is an interesting and important topic of study. The economist writes â€Å"Chasing the Anti-China Vote† as an article to speak of the elections. But, I happen to agree with Obama that outsourcing and manufacturing in China is there to stay so the way forward is not unilateral changes or demands. I believe China do es need America’s presence in the pacific as a police figure to help.It is similar to the situations at the turn of the 20th century. Company overview of pakistan telecommunication company limited Introduction Pakistan Telecommunication Company Limited (PTCL) is the largest telecommunication company in Pakistan. PTCL provides telephonic services to the nation and is the backbone for countrys telecommunication infrastructure. The company consists of around 2000 telephone exchanges across Pakistan. They provide the largest fixed line (land-line) network, currently having 4.8 million fixed line customers. GSM, CDMA and Internet are other services of PTCL. The Government of Pakistan sold 26% shares and control of the company to Etisalat (U.A.Es telecom company) in 2006. The Government of Pakistan retained 62% of the shares while the remaining 12% are with the general public. PTCL also provides Wireless Telephonic network by the name of Vfone, having 1.25 million active customers. Ufone, which is the second largest cellular network in the country, is also owned as a subsidiary of PTCL. Ufone has about 6.5 million mobile subscribers and a market share of nearly 25% currently in Pakistan. PTCL ha s the potential to be an influential means in Pakistans economic growth. Privatization of PTCL The process of the privatization of the state owned and managed PTCL was initiated in November 2004. Early in January 2005, 18 companies registered their EOI (Expressions of Interest), out which 3 bidders qualified for the final bidding which held on June 18, 2006. Dubai based company Consortium of Emirates Telecommunication Corporation (Etisalat) and Dubai Islamic Bank, Etisalat International Pakistan (EIP) gave the highest bid US $ 1.96 per share, equivalent to PKR 117.01 per share, which translates into US 2,598,960,000 (2.599 billion) or PKR 155,157,912,000.00. After the purchase of shares of PTCL Etisalat was given permission to fully control the management, which is against the provisions of Companies Ordinance of Pakistan, 1984. This deal has also created much of a drama within the company as well. The employees of PTCL resist this deal and there had been strikes in PTCL offices to oppose this. As many as 40,000 people will quit the job through Voluntary Separation Scheme (VSS) offered by the PTCL management. 60 percent of employees may opt for VSS. Among the 44,000 employees 26,400 will quit the services who have served the organization for as many as 20 years. The cases had been signed by opposition, employees of PTCL against all this scenario and they are still waiting in Supreme Court for hearing. After privatization of PTCL, the company remained encircled by various controversies and disputes, mainly due to bad management by PTCL administration and lack of interest from Government. PTCL employees came to know about a new contract named as U.P.S (Unified Pay Scale). U.P.S highlighted that the previous employment agreements were null and void and no previous benefits could be claimed by any of the employee of PTCL. U.P.S also dispossessed the employees of their respective pensions. Until and unless their demands are met, the employees of PTCL are on a protest. As much as 21000 employees of PTCL would be affected by U.P.S. Employees believe that U.P.S was bought in PTCL to change the status of the employees to contractual status, instead of their permanent ones which was present before. Government had promised the employees that they would be receiving facilities like, pay scale/allowances up gradations, but they were never fulfilled, as the event of privatization had taken place. Significance/Rationale of the study The significance of this study is to identify the post effects of privatization on the employees of PTCL. We will be identifying the level of satisfaction of the employees after the privatization of PTCL. The performance of their employees and similar other indicators will exuberate the dedication of employees to this organization. There is a need for a study concerning how employees perceive changes in their employment system, since this process will result in the change of the management and the policies that were present in PTCL before privatization. Generally, a well motivated and a satisfied employee means that the organization is achieving high levels of productivity. Similarly, if the employee has negative reactions for this process, that would result in de-motivation and dissatisfaction of employees. Set of variables Literature Review Concepts and definitions Privatization can be simply explained as a process in which the ownership transfers from  Government hand to private hand. This term is also known as denationalization. It means transferring the control of a firm from the government sector to the private sector. It can be accomplished by sale or lease such as government selling 100% of an enterprise or selling 51% or even by selling a minority stake as long as the private sector is given full managerial (management) control. In financial terms, privatization means transferring a company from one whose shares are listed on the stock exchange and can be bought by the general public to one that is no longer listed or publicly traded because it has been bought by a private group. Privatization takes place to reduce the depletion of Government resources caused by losses of the state owned enterprises, this mostly creates  greater opportunities for the private sector to expand and modernize  these enterprises. Productivity, efficiency, profitability increases and the  development of a valuable capital market occurs which releases resources for  development of the social and physical infrastructure. The process of privatization has some disadvantages as well. Private firms tend to be more efficient and cost effective so the excess workers are laid off to minimize costs. Employees do not benefit from paid leaves, which are given to government employees. Employees also dont get contracts for life time job in privatization, which they do get in the public sector. Hassan (2008) stated that Saudi Arabia is experiencing the expenditures of public sector. Privatization does have an impact on employees in public organizations. When there is a policy of gradual privatization, the old employees are trained in a certain manner, as to be ready for their new jobs respectively. If the company is sold through selling stocks than some of stocks should be sold to the employees themselves or given it to them (stock options). This increases their interest in the company and they become more motivated and satisfied. The resultant is good governance and profit. During the privatization period there should be certain specialized organizations who should be allowed to take part in processes in order to find solutions or relocation of surplus labor force. Employees should be motivated and trained from specialized trainers before and after the privatization period as it results in better performance and productivity. Bhaskar and Khan (1995) states in the jute indu stry case, privatization reduced employment considerably, while the output was not much reduced. Reduction in jobs was mainly of managers and the labor or mill-workers were not fired after privatization. The employment of manual (labor force) workers was increased in the privatized firms. Brown, Earle and Telegdy (2008) states that the greatest resistance of privatizing a firm usually comes from the firms own employees, who are afraid of wage cuts and job losses. The new management of privatized firms reduces the organizations labor costs as harder budget constraints and stronger profit-related incentives are promoted by them. This is called as the Efficiency Effect of privatization. The lower costs increase the firms market share and the total quantity demanded for the industry. New owners may reduce wages in order to cut back costs but if the firm plans to expand, then they might offer high wages to attract new better and trained workers. Also, the new owners might bring in high tech machinery which does the job of attracting workers with higher skills, thus they get higher wages. Cunha and Cooper (2005) states that the companies which are undergoing the process of privatization, several issues take place with the employees of that organization. Some of them are, role confusion, role over-load and under load, new-work relationships, job insecurity, career advancement/future trainings and deterioration of working conditions. All these factors may lead to physical health symptoms such as headaches, depressions, cardiovascular diseases, tension and anxiety etc, these factors and all of the listed above lead to dissatisfaction of the job subsequently. Falkenberg, Naswall, Sverke1 and Sjoberg (2009) states the employees working at different hierarchic levels have different resources and means to handle uncertainty associated with change (in our case privatization). Employees at a higher level of hierarchy have a greater responsibility in an organization and thus could experience more stress than other employee. Research also suggests that employees at higher positions are better able to handle uncertainty, as they are having more access to resources that help improve the possible negative consequences of privatization. Higher level executives tend to report less suffering than other employees during privatization. The employees present at the lower hierarchic levels, who have fewer resources for handling change disorder, there is an inclination for them to be more negatively affected by privatization. In conclusion, we can observe that dissatisfaction is observed at all levels of the hierarchy, whereas the greatest levels of disarr ay experienced as we move down from the top to the bottom levels. Critical Analysis of literature The articles in the literature reveal that privatization in the major parts of the world has created dissatisfaction amongst employees. Apart from the advantages of privatization to the firm itself and the employees, the method causes the firms to become cost effective, which means that downsizing takes place, jobs are lost. Paid leaves were offered to public sector employees along with life-time contractual jobs in most scenarios. All of this is removed once privatization takes place. As the management changes, the existing employees get confused about their roles, they experience stress, which leads to health problems such as cardiovascular (heart) diseases, depression, headaches etc. Usually, higher level executives are less affected than other employees during privatization. The employees present at the lower hierarchic levels, which have fewer resources, are more negatively affected by privatization. Independent Variables: Fear of Job insecurity: Employees will have a constant fear of job security which was not present before with the firm when it was owned by the state. Stock-option plan: The employees if given a stock option plan would make them involved in the organization, as they would have a feeling of control and involvement in the firm. Overall we can conclude that the variables identified in out framework do strongly affect the satisfaction level of employees at PTCL after privatization. Employees strongly agree that they have a certain fear of losing their jobs after privatization. Stock option plans, or giving employees stock/share as added benefits instead of cash bonus etc. would increase satisfaction levels and make the employees more productive in the privatized firm. The employees agreed for having regular handing out of the stock options in the company. Fringe benefits are those services that motivate the employees and increase their satisfaction levels considerably. Employees were disagree, when they were asked to assess the fringe benefits as direct measure of their satisfaction levels in PTCL after privatization. Employee unions or those entities that safeguard the rights of employees. Employees responses were strongly disagre e that there were no Employees Union present in their organization. Basically these unions prevent unfair measures from happening with the employees. Training and development enhances the careers of employee and grooms them in the corporate world. It also paves way for their promotions in an organization. The employees responses were mostly disagreed because there was no training given to them after privatization. Training should be given to them that help them in their career progression. Rewards should be given to them on timely basis and all kind of monetary/non-monetary rewards should be given to them. To appreciate the employees who complete their Projects/goals before time rewards should be given to them so that they get motivated and satisfied and achieve high.

Nursing Management of a Chronic Illness: Diabetes Maddison Adams Over time, ineffective management of diabetes can lead to a number of health related problems such as damage to the heart, blood vessels, eyes, kidneys and nerves. Diabetes is a rapidly growing health epidemic. Insulin is a hormone that is produced to regular blood sugar levels. Diabetes is a chronic illness that can be caused by the pancreas producing an inadequate amount of insulin; this is referred to as type 1 diabetes. Type 1 diabetes is not preventable and the cause is not known. Type 2 diabetes is characterized by the body ineffectively using the insulin produced by the pancreas. This type of diabetes occurs in approximately 90% of the individuals living with diabetes. It is mainly caused by obesity and lack of physical exercise. Another type of diabetes is referred to as gestational diabetes; this is caused by hyperglycemia during pregnancy. The incidence of both type 1 and type 2 diabetes has made a dramatic increase in recent years. It is classified as one of the world†™s leading causes of illness and premature death. Powerlessness is referred to as the feelings expressed by an individual suffering from a chronic illness, it can occur at some point during their illness. There are numerous methods in which individuals with diabetes can control and be involved in their own healthcare. Nurses play a very important role in improving the health outcomes of individuals living with diabetes. Some strategies a nurse can implement to empower and facilitate self-management for patients and families or carers include: educating the client about correct administration of insulin and blood glucose monitoring, empowerment of the client in order for them to recognize and acknowledge the amount of control their have and require regarding their own health outcomes as well as assisting the client with the development of realistic and attainable healthcare goals. The client is in complete control of their healthcare requirements. Previous research has highlighted the importance of the role of the nurse and how they can improve client compliance and ultimately improve the quality of life in individuals living with diabetes. This improvement is influenced by education and empowerment techniques implemented by the nurse that enable the client to effectively self-manage their chronic illness. Diabetes is a worldwide health epidemic, therefore it is critical that individuals involved in the care of a client with diabetes take the necessary action to educate and empower the client with diabetes. Recent statistics has highlighted the prevalence of diabetes. In 2013, approximately 347 million individuals worldwide lived with diabetes. It is predicted that by 2030, diabetes will be the seventh leading cause of death. Complications associated with diabetes includes kidney failure, cardiovascular disease, diabetic retinopathy and diabetic neuropathy. Ac cording to WHO, in 2004 it was estimated that 34 million individuals died as a result of the complications of diabetes such as hyperglycemia. Poorly controlled diabetes contributes to other consequences other than the physical consequences. These include: the emotional impact on the individual and family or carer and the financial issues associated with living with a chronic illness. These consequences combine to result in the client with diabetes becoming less compliant and also experiencing a reduced quality of life. The negative consequence of living with diabetes exposes the client to the risks of lifelong financial and emotional issues. The nurse plays a diverse role in assisting their client with education regarding how to embrace their chronic illness with the aim to achieve the best possible quality of life. Introducing an explaining the medical interventions that are implemented in order to manage diabetes, such as insulin and blood glucose monitoring, encourages the creation of realistic and attainable goals as well as assisting the client to form what to self-manage and learn certain copying techniques in order to gain control over with health outcomes, avoiding the illness taking control are some strategies that allows the clients to make informed choice and changes to their healthcare in the future. The first strategy the nurse can implement is assisting their client with developing realistic and attainable goals in regards to their longtime diabetes management. Encouraging the client to create health care goals will not always lead to the client attaining them. The nurse must understand and be aware of the various problems related to helping their client develop health care goals that are realistic, and especially attainable. The goals the client creates must be specific and based on physical outcomes (e.g. not drinking sweetened beverages), measureable (e.g. running for half an hour twice a week), action orientated (e.g. exercise). The goals must be both challenging but realistic so that the client is not discouraged by the over challenging goals or has no sense of accomplishment due to ease of attaining goal. There are numerous barriers that are related to creating goals and may deter the client from achieving them. Knowledge deficit regarding the influence of lifestyle factors on diabetes management may cause clients to misunderstand the importance of setting health goals and prevent them from adhering to them. The client may also avoid changes to their health behavior goals due to emotional barriers such as lack of motivation. Another disadvantage the nurse may face when assisting their client with creating a goal is lack of finances and barriers in available resources. These barriers include lack of money and lack of social support systems. Clients may require assistance with planning ways to overcome difficulties to attaining health goals. These difficulties may include the inability to afford fresh fruit and vegetables to maintain a nutrient rich diet. It is important that strategies are in place for each barrier the nurse identifies in order to overcome them. This is due to some cli ents lacking the skills required to solve problems that may come in contact with when living with a chronic illness when consumed with other issues such as financial difficulties. Another strategy the nurse can implement is educating the client on the correct administration of insulin and blood glucose monitoring. Many barriers can impair the client’s ability to self-manage their diabetes in an effective manner despite having been educated on medication administration and blood glucose monitoring. Clients may be resistant to following a insulin administration regimen due to factors such as fear of administrating an injection, being uncertain about the correct injection techniques and being afraid of having a hyperglycemia or hypoglycemic episode. These concerns are shared among individuals with diabetes in regards to monitoring their blood glucose levels. According to H, the clients that became tolerant of daily blood glucose monitoring remain unaware of how to correctly interpret the blood glucose levels and were unaware of how to change their food consumption and contribution to physical activity, let alone determine when insulin administration was re quired. Current diabetes self-management education (DSME) is a short program that clients with diabetes complete and involves education regarding basic self-management skills. Further education and developments of these skills is required in order to allow patients to possess the adequate knowledge and the comfort required to effectively manage their illness for their lifetime. Another barrier related to educating the client on the correct administration of insulin and blood glucose monitoring involves lack of finances that are required to adequately maintain control of the client’s chronic illness. A client that has been diagnosed with diabetes will live with the illness for their entire life; therefore the financial impact on the client will be lifelong. The financial impact of living with a chronic illness such as diabetes can contribute to emotional and financial difficulties that may have a negative effect on the client self-management efforts. Issues the client may face living with diabetes includes the inability to afford the supplies required to maintain specific health goals. This financial difficulty can be caused by lack of health insurance or low socio-economic status and has the potential to put the client at risk of having reduced compliance and poorer health outcomes. According to Stys (2007), client’s living with diabetes that have health insurance can afford prescription medications and therefore are involved in better health outcomes compared to client without health insurance. Also, many clients are able to self-manage their diabetes but are unable to due to financial difficulties. The final strategy the nurse can implement is assisting the patient to develop copying techniques as well as empowering them to identify and acknowledge the control they have on their diabetes. Educating the client regarding ways to cope and empowering them to effectively self-manage their diabetes is an important role of the nurse. The client may experience stress as a result of the fear of the complications of diabetes, depression, tough medication and diet guidelines and the feeling of being overwhelmed is associated with the client being less likely to effectively self-manage their illness. Morbidity, mortality, limitation to function and reduced quality of life can been caused by emotional distress. The nurse must respond to stress experienced by their client quickly in order to adequate educate them on ways of coping with diabetes as well as encouraging the client to gain a reasonable understanding and acceptance of their illness. This is a requirement for patients living with diabetes and will result in the client feeling empowered and in control of their health. Despite advances in the treatment of diabetes, clients with the chronic illness have less than optimal control and therefore suffer from preventable complications associated with it. There are numerous methods in which individuals with diabetes can control and be involved in their own healthcare. Previous research has highlighted the importance of the role of the nurse and how they can improve client compliance and ultimately improve the quality of life in individuals living with diabetes. This improvement is influenced by education and empowerment techniques implemented by the nurse that enable the client to effectively self-manage their chronic illness. Mesopotamia Is Great The "Land Between the Rivers" has been a source of both savage barbarism and great civilizations. Mesopotamian culture reached its peak between ca 3000-550 BCE. Yet, much of Mesopotamian culture goes unnoticed, despite its rich heritage. A vast bulk of the great early civilizations developed in the land known as Mesopotamia. It can, in fact, be proven, without question, that because of Mesopotamia's extensive trade routes, its excellent leaders, and the astronomical growth in technology that occurred, that Mesopotamia was one of the greatest civilizations to have ever existed. For its time, Mesopotamian culture had the greatest trade routes. Its trade network reached from the sands of Egypt to the deserts in India. Most certainly no civilization in the western world at that time had not heard of the great cultures that existed between the Tigris and the Euphrates. Egypt, in itself, had an excellent trade route with its access to the Mediterranean sea. Mesopotamia, however, had trade routes not only in Egypt, but in many other locations to the east as well. All previous trade routes had been confined from village to village. Through its extensive trade route, it can be seen that Mesopotamia was a great civilization. Mesopotamia did not only have trade routes as a testament to its greatness, but a flourishing government as well. As Mesopotamia was racked with barbarian invasions, the rise of some of History's most fearsome and great leaders can be seen. Sargon I, for example, managed to unify one of the largest areas of civilization at that time. Sargon I is also noted having never lost a single war in his entire life. As well, with Mesopotamia, the first system-and indeed the most extensive in that point in time-of codified law. King Hammurabi's aptly titled system of codified law, the Code of Hammurabi, while seemingly harsh in today's view, was heralded as a just and fair law back in its day. History also shows that one of the greatest Ziggurats of all time was created in the land of Mesopotamia.. Nebuchadrezzar II's Hanging Gardens of Bablyon is noted as being one of the greatest marvels of the ancient world. With such a glorious string of leaders, it is obvious to conclude that Mesopotamia w as one of the greatest civilizations ever to have existed. Aside from its string of incredible leaders, History shows that Mesopotamian culture gave birth to some of the greatest technology man has ever developed.

Winter Moon :: essays research papers

Critique of Winter Moon In Winter Moon by Dean Koontz a cloudy Los Angeles, California day is shattered when a hot Hollywood director turns a city street into a fiery abyss. A heroic police officer, Jack McGarvey, is badly wounded in the inferno and will not be able to walk for months. Little does Jack know that a series of events will lead him and his family to a ranch in Montana. On that isolated ranch they discover their destiny in a horrific encounter with a ruthless and puzzling enemy from which neither the living nor dead are safe. Koontz’s novels seem to have one thing in common. Their themes are about how the human mind and spirit relate to things in life. He doesn’t stray from that commonality in Winter Moon. Koontz’s purpose in writing the book was to show that the power of the mind is yet an unmatched force. Both my mother and I agree that he accomplished this very well. His use of characters also fits a pattern that has developed in his writing. Koontz uses the same two characters in many of his novels: the heroic, faithful male and the strong female. Koontz’s employment of indirect characterization is impeccable, and makes the reader feel as though they really know the characters. At the beginning, the book can seem confusing, whereas Koontz jumps back and forth from character to character. I feel that after the reader has become accustomed to it, the switching between characters creates good stopping points. However, my mom found it annoying and didn’t like the switching. Koontz explodes into action during the first chapter, which grips the reader and holds their attention throughout the rest of the book. The novel starts out as two separate stories: a police officer’s family living in L.A. and an old retired man living in Montana. As the book progresses the two stories become more connected, and finally intertwined. The book can seem confusing at the start. However, the confusion of the reader is used by Koontz to make the ending more intense. Koontz certainly unleashes his vivid imagination in this novel, whereas some of the details and occurrences can leave a weak stomached reader feeling nauseous. My mom said that she couldn’t sleep after reading one of the more disturbing sequences of events. The setting of Winter Moon occurs in two different places. Two places that are complete opposites: Los Angeles, California and a ranch in Montana.

COMPUTER HACKING AND CYBER CRIME LAW History of Hacking According to (Clifford R.D. 2006) a cracker or cracking is to â€Å"gain unauthorized access to a computer in order to commit another crime such as destroying information contained in that system†. These subgroups may also be defined by the legal status of their activities. Eric S. Raymond (author of The New Hacker’s Dictionary) advocates that members of the computer underground should be called crackers. Yet, those people see themselves as hackers and even try to include the views of Raymond in what they see as one wider hacker culture, a view harshly rejected by Raymond himself. Instead of a hacker/cracker dichotomy, they give more emphasis to a spectrum of different categories, such as white hat, grey hat, black hat and script kiddie. World Of Hacking Hacking is the practice of modifying the features of a system, in order to accomplish a goal outside of the creator’s original purpose. Hacker A hacker is someone who seeks and exploits weaknesses in a computer system or computer network. Hackers may be motivated by a multitude of reasons, such as profit, protest, or challenge. The subculture that has evolved around hackers is often referred to as the computer underground and is now a known community. White Hats – good Gray hats – good or bad Black hats – bad Script kiddie A script kiddie (also known as a skid or skiddie) is a non-expert who breaks  into computer systems by using pre-packaged automated tools written by others, usually with little understanding of the underlying concept—hence the term script (i.e. a prearranged plan or set of activities) kiddie (i.e. kid, child—an individual lacking knowledge and experience, immature). Blue hat A blue hat hacker is someone outside computer security consulting firms who is used to bug test a system prior to its launch, looking for exploits so they can be closed. Microsoft also uses the term Blue Hat to represent a series of security briefing events. Hacker Code Of Ethics Levy (1984) suggests that there is a â€Å"code of ethics† for hacking which, though not pasted on the walls, is in the air: Access to Computers – and anything which might teach you something about the way the world works – should be unlimited and total. CYBER CRIME LAW Senator Angara is defined as any illegal and criminal act activity committed on the internet. State Policy Regarding Cyber Crimes The State Recognize.. 1. The vital role of information and communication industries such as content production, telecommunication, broadcasting, electronic commerce, and data processing, in the nation’s overall social and economic development. 2. The importance of providing an environment conducive to the development, acceleration, and rational application and exploitation of information and communication technology to attain free, easy and intelligible access to exchange and/or delivery of information. 3. The need to protect and safeguard the integrity of computer, computer and communication systems, network, and databases and the confidentiality, integrity, and availability of information and data stored therein, from all forms of misuse, abuse, and  illegal access by making punishable under the law such conduct or conducts. Cyber Crimes Offenses 1. Offenses against the confidentiality, integrity and availability of computer data and systems. A. Illegal Access – The intentional access to the whole or any part of a computer system without right. Element of Computer System There must be a device a group of interconnected or related devices. At least one of the devices performs automatic processing of data pursuant to a program. The device need NOT be connected in a network as long as it consists of both hardware and software and have input, output and storage facilities. Element of the offense of illegal Access 1.There must be an intentional access in whole or any part of a computer system. 2. The person who attempts, or is accessing, or had already access the data has no right to access to the system. â€Å"An Authorized person may not be authorized.† B. Illegal Interception Interception – refers to the listening to, recording, monitoring or surveillance of the content of communication. Elements of Illegal Interception 1. It must be intentional. 2. It must be by technical means. 3. The person involved is without any right to do the intercept. 4. The transmission of computer data to, from, or within a computer system is non-public. 5. It must not fall in any exemption. C. Data Interference Intentional or reckless alteration of computer data without right. C.System Interference Intentional or reckless hindering without the right of the functioning of a computer system by inputting, transmitting, deleting or altering computer data or program. MisUse of Devices The use, production, sale, procurement, importation, distribution, or otherwise making available, without right, of: – device, including a  computer program, designed or adapted primarily for the purpose of committing any of then offenses under this act; Or -a computer password, access code, or similar data by which the whole or any part of a computer system is capable of being accessed with intent that it be used for the purpose of committing any of the offenses under this Act; CYBERSEX AND CHILD PORNOGRAPHY CYBERSEX -Any person who establishes, maintains or controls, directly or indirectly any operation for sexual activity or arousal with the aid of or through the use of a computer system, for a favor or consideration. Child Pornography -refers to pornography depicting sexually explicit activities involving a child. It may use a variety of media, including writings, magazines, photos, sculpture, drawing, cartoon, painting, animation, sound recording, film video, and video games. Child pornography is divided into simulated child pornography and pornography which was produced with direct involvement of the child (also known as Child Abuse Images.) For a person to be guilty of cybersex as defined by the cybercrime law, all the following elements must be present: There must be an operation for sexual activity or arousal; The sexual activity or arousal is done with the aid of or through the use of a computer system; The activity is done for a favor or consideration. The operation is/ was established, maintained or controlled by a person directly or indirectly. From the above, element no.3 should NOT have been included by our law makers. What is the Penalty for this Crime? Any person found guilty of the cybercrime of cybersex shall be punished with imprisonment of prison mayor or a fine at least Two Hundred Thousand Pesos ( Php 200,000.00) But not exceeding One Million Pesos (1,000,000.00) or both. Sec. 5 Other Offenses: The following acts shall also constitute an offense: 1. Aiding or abetting in the Commission of Cybercrime– Any person who willfully abets or aids in the commission of any of the offenses enumerated in this Act shall be held liable. 2. Attempt in the Commission of Cybercrime– A prosecution who willfully attempts to commit any offenses enumerated in this Act shall be held liable. Sec. 6 Liability under other Laws A prosecution under this Act shall be w/o prejudice to any liability for violation Of the Revised Penal Code, as amended or special laws COMPUTER-RELATED OFFENSES: Computer-related forgery Computer-related Fraud Unsolicited Commercial Communications 1.) Computer-related Forgery -(a) the intentional input, alteration, or deletion of any computer data w/o right resulting in inauthentic data w/ the intent that it be considered or acted upon for legal purposes as if it were authentic, regardless, whether or not the data is directly readable and intelligible; (b) the act of knowingly using computer data which is the product of computer-related forgery as defined herein, for the purpose of perpetuating a fraudulent or dishonest design. 2.) A pe rson is guilty of forgery if: (a)With purpose to defraud or injure anyone; OR (b) With knowledge that he is facilitating a fraud or injury to be perpetrated by anyone; the actor: 1.) alters any writings of another without his authority; 2.) makes, completes, executes, authenticates, issues or transfers any writing so that it purports to be the act of another who did not authorize the act, or to have been executed at a time or place or in a numbered sequence other than was in fact the case, or to be a copy of an original when no such original existed; or 3.) utters any writing which he knows to be forged in a manner specified in the revised penal code. Elements of Computer related Forgery. First type of Offense â€Å"ACTIVE COMPUTER RELATED FORGERY† (a) There must be an intentional input, alteration, or deletion of any computer data without right; (b) The result is an inauthentic data; (c) The intent is to use the inauthentic data to be considered or acted upon as if it is authentic Second type of Offense â€Å"PASSIVE COMPUTER RELATED FORGERY a) There must be an existing inauthentic data brought about by the elements of ACTIVE computer-related forgery. b) Knowingly acting on the inauthentic data for the purpose of perpetuating a fraudulent or dishonest design. 2.) Computer Related Fraud If A had a loan from his cooperative and the only evidence of such loan is the records stored in the cooperative’s computer system, A with intent to procure economic benefit, changed the source code of the system’s program so that on an particular date, the system will hang and immediately cause the malfunctioning of the said system. Thus, A can easily deny that he still has an obligation to the cooperative. 3.) Unsolicited Commercial Communications -The transmission of commercial electronic communication with the use of a computer system which seek to advertise, sell, or offer for sale products and services are prohibited unless a. There is a prior affirmative consent from the recipient; or b. The following conditions are present: i. The commercial electronic communication contains a simple, valid, and reliable way for the recipient to reject receipt of further commercial electronic messages (‘opt-out’) from the same source; ii. The commercial electronic communication does not purposely disguise the source of the electronic message; and iii. The commercial electronic communication does not purposely include misleading information in any part of the message in order to induce in the recipients to read the message. Through his blogs. INTRODUCTION With the emergence and popularity of blogging as a new form of expression, the coverage of defamation laws has extended to cyberspace. The consequences is that, people who are adversely affected by writings in this medium is bringing lawsuits to protect their name and reputation. While the Philippine Constitution protects bloggers’ right to free speech and expression, this does not give them unfettered license to write to the detriment of others. This Chapter discusses the person’s right to free speech and expression while respecting the person’s honor. This chapter aims to equip the reader relevant knowledge to supplement his skills in determining whether or not a certain form of expression is within the scope guaranteed by the Constitution. Bases of the Guaranteed of the Right of Freedom of Expression Two (2) Philosophical Bases for the Guarantee of this Right Discovery of truth For self-government In the case of US vs. Bustos (37 Phil. 731), in which the defendants were charged with libel of a public officials for statements made Mr. Justice Malcolm, writing the opinion of the Court, said: â€Å"Public policy, the welfare of society, and the orderly administration of government, have demanded protection for public opinion. The inevitable and incontestable result has been the development and adaptation of the doctrine of privilege.† `â€Å"A public official must NOT be too thin-skinned with reference to comment upon his official acts.† Scope of the Freedom of Expression Article III, Section 4 of the Phil. Constitution says: â€Å"No law shall be passed abridging the freedom speech, of expression, or the press, or the right of the people peaceably to assemble and petition the Government for redress of grievances.† Article III, Section 18(1) of the Phil. Constitution says: â€Å"No person shall be detained solely by reason of his political beliefs and aspirations.† Question: But how can we determine the scope of this expression? According to Justice Isagani Cruz, an authority in Constitutional law, the ideas that may be expressed under this freedom are NOT confined only to those that are sympathetic or acceptable to the majority. To be really meaningful, it should permit the articulation of even the unorthodox view, though it be unfriendly to or mocked by others, or â€Å"induces a condition of unrest, creates dissatisfaction with conditions as they are, or even stirs people to anger.† Justice Holmes said that this right exists NOT so much for the thought that AGREES with us as for the thought that we detest. From this comes the famous statement from Voltaire: Voltaire â€Å"I may NOT agree with what you say, but I will defend to the dead your right to say it†. Freedom from prior restraint or censorship Prior means official governmental restrictions on the press or other forms of expression in advance of actual publication or dissemination. Freedom from subsequent punishment The freedom from prior restraint would set at naught if the citizen would hesitate to speak for fear of vengeance that he might suffer against the officials he criticized. Limitations on the Guarantee Case: Tulfo wrote an article in his column in PDI ‘On Target’ on October 13, 1989, stating that the Supreme Court rendered an idiotic decision in legalizing checkpoints, and again on October 16, 1989, where he called the SC stupid and â€Å"sangkatutak na mga bobo justices of the Philippine Supreme Court†. There are 2 kinds of publications which can be punished for contempt: 1.Those whose object is to affect the decision in a pending case 2.Whose object is to bring courts to discredit Standards for allowable subsequent punishment TEST CRITERION 1.Dangerous Tendency Test There should be a RATIONAL CONNECTION between the speech and the evil apprehend 2.Clear and Present Danger Test There should be a clear and present danger that the words when used under such circumstances are of such a nature as to create a CLEAR AND PRESENT DANGER that they will bring about the substantive evils that the State has a right to prevent 3.Balancing of Interest Test The courts should BALANCE the PUBLIC INTEREST served by legislation on one hand and the FREEDOM OF SPEECH (or any other constitutional right) on the other. The courts will then decide where the greater weight should be placed LIBEL A legal term for something written which is harmful to a persons reputation. – is a defamation committed by means of writing, printing, lithography, engraving, radio, phonography, painting, theatrical exhibition, cinematographic exhibition, or any similar means. Libel is punished by our Revised Penal Code which states: Art. 353. Definition of Libel. – A libel is public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status, or circumstance tending to cause the dishonor, discredit, or contempt of a natural or juridical person, or to blacken the memory of one who is dead. Art. 354. Requirement for Publicity. – Every defamatory imputation is presumed to be malicious, even if it be true, if no good intention and justifiable motive for making it is shown, except in the following cases: 1.A private communication made by any person to another in the performance of any legal, moral or social duty; and 2.A fair and true report, made in good faith, without any comments or remarks, of any judicial, legislative or other official proceedings which are not of confidential nature, or any of statement, report or speech delivered in said proceedings, or of any other act performed by public officers in the exercise of their functions Art. 355. Libel means by writings or similar means. – A libel committed by means of writing, printing, lithography, engraving, radio, phonography, painting, theatrical exhibitions, cinematographic exhibition, or any similar means, shall be punished by prison correctional in its minimum and medium periods or a fine ranging from 200 to 6,000, or both, in addition to the civil action which may be brought by the offended party. DefamationElements of Defamation For a person to be convicted of defamation, the following elements should be present. 1. There must be an imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status, or circumstance. 2. The imputation must be made publicly. 3. It must be malicious. 4. The imputation must be directed at a natural or juridical person, or one who is dead. 5. The imputation must tend to cause the dishonor, discredit, or contempt of the person defamed. Absolute Privileged Communication To illustrate, let us recall the privileged speech delivered by Sen. Revilla in the Senate last 2009, in that instance, he called Dr. Hayden Kho â€Å"Maniac†. Buwang itong doctor na ito. Baliw, Mr. President,† he further said. Qualified or Conditionally Privileged Communications Under this privilege, the freedom of the liability for an otherwise defamatory utterance is conditioned on the absence of express malice or malice in fact. Thus, in re:Tulfo (supra), notwithstanding the freedom of the press guarantee of the Constitution, the respondent was severely censured because there is malice brought about by a disrespectful language. A good example which will illustrate the absence of malice in rendering fair and true report is the case of GMA Network vs Bustos (G.R. No. 146848 October 17,2006). Interpreting The Libelous Statement The alleged libelous article must be construed as a whole (Jimenez vs. Reyes, 27 Phil.52) The Meaning given by the writer nor by the offended person is Immaterial. If the libelous statement shall be interpreted by the writer, then the writer can easily escapes by giving an interpretation to the effect that malice is not present. On the other hand. If the offender person is the one who will interpret the libelous article, he can easily imputes malice against the writer to hold him liable. Meaning of Publication Publications does not mean that the defamatory statement should be published in the newspaper of general circulation, televised in national television, neither by refereed ISI Journal, etc. There is publication when the communication of the defamatory matter is made to some third person or persons( People vs Atencio, Dec 14,1954) Thus, If Juan sent a letter to Pedro which reads: â€Å"Pablo is a thief†, this is sufficient publication. ‘ Identification of the Party is Required in the 4thElement A blind item writer cannot be guilty of libel , as long as the person defamed cannot be identified. Thus, if the blind item states: â€Å"The wife of the pound for pound king†¦Ã¢â‚¬  Although the name is not expressly mentioned, the person can be easily identified, so the writer may be liable. General Rule: Every defamatory imputation is presumed to be malicious, even if it be true, if no good intention and justifiable motive for making it is shown, Exception: Except in the following cases: {This is the exemption to the general rule; here malice is NOT presumed} A Private communication made by any person to another in the performance of any legal, moral, or social duty; and A fair and true report, made in good faith, without any comments or remarks, of any judicial, legislative or other official proceedings which are not of confidential nature, or of any statement, report or speech delivered in said proceedings, or of any other act performed by public officers in the exercise of their functions. Going back to our previous example, if Juan sent a letter to Pedro which reads: â€Å"Pablo is a Thief† , it is presumed that that there is MALICE on the part of Juan. It means that the law presumes that Juan is prompted by personal ill-will in making the communication to Pedro. Now, suppose Pablo really is a thief, will the law still presumed malice on the part of Juan? Yes, unless Juan has good intention and justifiable motive in making communication. Thus, If Pedro is looking for a cashier in his department store Juan will be justified in making the communication so that Pedro won’t hire Pablo who applied for the cashier position. The same holds true if the message was sent through an e-mail and/or text messages. Relevance of Knowing the Presumption of Law If the case falls under the general rule, that is, malice is presumed, it is the writer or the accused who has the burden of proof. Hence, the complainant will NOT be obliged to prove that there is a malice on the part of the accused. The accused will have to produce evidence that his claim against the complainant is true. Do not be confused, the accused is the writer that is why he is being accused of libel because he is the one who wrote the libellous statement. The complainant is the offended party, that is, the person defamed that is why he is the one complaining. If the case falls under the exemption, it is the complainant who has the burden of proof like in the case of GMA Network vs Bustos, wherein Bustos, the complainant failed to prove that there is bad faith or malice on the part of GMA in showing the alleged malicious report. Libel in the Internet After reading the necessary materials pertaining to an individual’s right to freedom of expression and the libel law, we are now ready to study its application using the internet as its medium. Let us start our study with the following scenario. Libel in the internet or e-libel is within the Scope  of Libel Defined in the Revised Penal code The case of Bonifacio vs Jimenez (supra), unfortunately, was misinterpreted by some because they cite this case to support their opinion that e-libel is beyond the ambit of libel provided by the Revised Penal Code. According to them since the SC had dismissed the case, it is already settled that e-libel cannot be punished in our jurisdiction. I beg to disagree. If you will read the full text of the case of bonifacio vs Jimenez, it is very clear that Jimenez did not win the case because of the wrong choice of option. If Jimenez simply alleged in the information that they are (or at least one of the offended parties) presently residing in the City of Makati at the time of the commission of the offense, that is enough to vest jurisdiction to the RTC-Makati and enable the letter to hear and decide the case on the merits. The case was dismissed because RTC-Makati failed to acquire jurisdiction of the case NOT because there is no e-libel in our country. Another argument is that, â€Å"at the time the revised penal code was enacted, there is no internet yet, hence, the legislature could NOT have intended to include internet as a medium. To address this argument let us reproduce the pertinent provision of the libel law regard to this, thus: Art.335.Libel means by writings or similar means. *A libel committed by means of writing, printing, lithography, engraving, radio, phonagraphy, painting, theatrical exhibit, cinematographic exhibition, or any similar means (big emphasis supplied).
